The Cayucos Sanitary District (“District”) provides a lateral locating and CCTV inspection service to customers within the District’s service area as a requirement of the Will-Serve process. This service is provided to assist property owners and contractors identify lateral defect locations, if any, and establish the location of sewer laterals between the sewer lateral cleanout and the wye connection to the sewer main. This service will only be provided to customers that provide a District-compliant lateral cleanout on or near their property line. In accordance with Ordinance No. 26, the property owner/contractor who receives a CCTV inspection will be solely responsible, at their sole cost, for the repair/replacement of the defective portion(s) of the lateral identified by the District. The District will provide sewer lateral location, lateral defect location, and CCTV inspection services only upon receiving the property owner’s written consent, provided below, and under the following conditions:
The District makes no representations or warranties as to the quality and/or effectiveness of this service and is in no way considering itself as capable of providing service commensurate with any trained or licensed third party. The information resulting from the District’s provision of the sewer lateral location services and/or lateral defect location service shall not be relied upon for any purpose, including, but not limited to, determining the existence of defects or determining the precise location of the sewer lateral. Should the property owner/contractor wish to obtain information upon which to rely, they should engage the services of a third party trained and licensed in the business of locating sewer laterals and/or lateral defects.
The property owner/contractor requesting a sewer lateral location, lateral defect location, or CCTV inspection on behalf of themselves and their agents, heirs, executors, administrators, trustees, shareholders, officers, directors, members, employees successors and assigns, hereby fully releases, defends, indemnifies, quits and forever discharges the District and its respective successors, agents, administrators, members, officers, directors and assigns, of and from any and all rights, claims, actions, causes of action, suits, debts, liens, obligations, reckonings, accounts damages, demands, liabilities, costs and expenses whatsoever, including attorney’s fees and costs, at law or in equity, known or unknown, anticipated or unanticipated and whensoever arising or accruing, that property owner or contractor, owns, holds or anytime heretofore ever had, owned or held or could, shall or may hereafter have, own or hold against the District, its agents, attorneys, administrators, members, officers, directors and assigns based upon, arising out of or in any way related to any of the services performed hereunder. The property owner/contractor fully understands and insures that by signing this disclaimer they cannot seek any remedies, at law or in equity, including seeking damages or monetary compensation from the District for any costs associated with the repair or replacement of their sewer lateral arising in any way out of the services performed hereunder.
